Changes to the Family Law Act from May 2024

​

The Family Law Amendment Act 2023 was passed by the Australian Parliament on 19 October 2023.

Most of the changes commenced on 6 May 2024.

These changes will affect you if:

a court is considering your parenting arrangements
you are trying to determine the right parenting arrangement for your child.
There are new laws for making parenting arrangements, including:

a simpler list of best interests factors for courts to consider when deciding parenting arrangements
the ‘presumption' of equal shared parental responsibility no longer exists.

There are a number of other important changes in the Family Law Amendment Act 2023. These include:

Requirements for Independent Children’s Lawyers to meet directly with children
Simpler compliance and enforcement provisions for child-related orders
New powers for the courts to prevent harmful litigation and

New powers to enable government to regulate family report writers.

Parenting & Property Mediation

 

Family Mediation Consultancy offer Parenting Mediation and Property Mediation where both parties can reach an agreement with the assistance of our fully qualified mediators accredited by the Attorney-General's Department. 

Our Mediation process involves an impartial third party who facilitates a conversation between two disputing parties with the aim of resolving their differences amicably.  Mediation boasts an impressive success rate, with over 90% of cases reaching a resolution through this method.  Our mediators have the authority to issue Section 60i Certificates for parties engaged in parenting mediations.  Our mediators have the expertise and experience as trusted mediators to assist you in resolving your family disputes.

Section 60i Certificates

The Family Law Act 1975 requires that parents that are not in agreement about their child’s parenting arrangements must attend mediation. They must also obtain a Certificate of Attendance (Section 60i Certificate) before an Application for a parenting Order can be made to the court.  When filing an Application, the court requires that a copy of the Section 60i Certificate be filed with the court Application, unless the court is satisfied that an exemption applies.

There are very limited reasons why a Court would accept an Application for filing, without a Section 60i certificate.

Family Mediation Consultancy provides Face to Face or Online Zoom mediation to our clients in a manner that is ideal for clients with busy lifestyles and clients that live or work in rural areas, by being available at times that may suit you, minimising the amount of time that you otherwise may need to take off work.   

In most matters, Family Mediation Consultancy and the process of Mediation is normally completed within 4 weeks.  Keeping mediations balanced and affordable.
